MULLER HOMES’ APPEAL DISMISSED

Local residents will be aware of the history to this decision, but in summary, the Borough Council refused two planning applications submitted by Muller Homes (12/3746N and 12/3747N) for development on land between Audlem Road/Broad Lane and Peter de Stapleigh Way.
This was eventually referred to the then Secretary of State, Eric Pickles who dismissed the appeal on 17 March 2015. Muller Homes challenged that decision in the High Court under what is known as a S.288 appeal.
The Department for Communities and Local Government has now informed the Parish Council that both appeals have been refused.
Matthew Theobald, Chairman of the Parish Council, said “It has been a long, protracted wait, but we are all delighted with the result, and I am sure that this will also be good news for residents. As Chairman of the Neighbourhood Plan Steering Group also, I was heartened to see that the Secretary of State has reached the view that no matter how well-landscaped, a housing development on this land would change the character of the parish for the worse. I would like to take this opportunity to thank the local MP, Edward Timpson and the local Ward Councillors, Peter Groves and Andrew Martin and, of course, all the local groups and residents who have supported us in our efforts to fight the appeal.”

STAPELEY DRAFT NEIGBOURHOOD PLAN - REGULATION 14 CONSULTATION

Stapeley & District Parish Council’s Neighbourhood Plan Steering Group has prepared a draft Neighbourhood Plan for the parishes of Stapeley and Batherton, which together form the administrative area of the Parish Council.

The consultation period for the Draft Plan has been extended and is now from 29 March 2016 until noon on 1 June 2016. The reasons for the extension can be found here.

Muller Appeal Dismissed

The decision has been announced (18th March 2015) that the appeal has been dismissed. The letter from the Department for Communities and Local Government

Sandy Gwinn-Freemantle, Chairman of the Parish Council, said "It has been a long wait but I am delighted with the result, as are my councillor colleagues and parish residents. The uncertainty has been unsettling. It is now even more important to press ahead with the Neighbourhood Plan to ensure that whatever development comes forward, it is in line with our own vision for the area. I would also like to take this opportunity to thank all the local groups and residents who have supported us in our efforts to fight the appeal."

 

Muller Homes - Public Inquiry Latest Posted on 24 October 2014

Following the Public Inquiry in February, it was expected that the Planning Inspector would publish his decision by 18 July 2014 in respect of Muller Homes’ applications on land between Audlem Road/Broad Lane and Peter de Stapleigh Way.  The matter was referred to the Secretary of State who then announced that he would make his decision on 1 September 2014.
On 1 September 2014, the Secretary of State then stated that he was unable to meet this revised date and would issue his decision “in the near future”.
Sandy Gwinn-Freemantle, Chairman of the Parish Council, said “We are disappointed that there is yet a further delay.  Parish councillors, along with residents are most anxious to have this matter finalised; the delay is unsettling.“
